How does protected tenancy (besittningsskydd) affect me?

As a general rule, protected tenancy does not apply to rentals covered by the Private Residential Lettings legislation. This means that the tenant will normally not have the right to remain in the property once the lease agreement expires or is terminated.

Protected tenancy may become relevant if you rent out more than two properties at the same time. In that case, the rental will generally not be covered by the Private Residential Lettings legislation but instead by the ordinary provisions of the Swedish Tenancy Act, which may provide the tenant with stronger protection. For rental apartments that are sublet, protected tenancy may arise after a certain period unless it has been validly waived.
